WHAT IS A SPECIAL NEEDS TRUST?

A Special Needs Trust is a way to invest money for a disabled person that allows them to continue to be eligible for special benefits such as Supplemental Security Income (SSI) from Social Security and Medicaid.  Entitlement to SSI and Medicaid are based on financial need.  However, when money is held in a Special Needs Trust, a person's entitlement to these benefits is preserved.  In this way, a disabled person can save money for the future without jeopardizing their income or health insurance.

 

Serving as a trustee for a Special Needs Trust requires an in-depth understanding of fiduciary responsibilities, Social Security regulations and Medicaid rules.
